§ 1 General
These General Terms and Conditions of Business (as amended) shall apply to business relationships of any kind between Jens Ritter Instruments and the customer. Customers may be businesses or consumers. A consumer shall mean any natural person who concludes a legal transaction for purposes that can be primarily attributed neither to a trade nor a profession (§ 13 of the German Civil Code). A business shall mean a natural or legal person or a partnership with legal capacity which, in concluding a legal transaction, is acting in the exercise of its trade or profession (§ 14 of the German Civil Code).
The currency used for all rates and for all transactions is the Euro ‐ currency code: EUR
§ 2 Payments
For Dealers

Standard Available Instruments: An order is considered confirmed after a down payment of 50% of the dealer price is received.
- Custom Orders: An order is considered confirmed after a down payment of 50% of the dealer price is received.
For Consumers and businesses

An order is considered confirmed after a down payment of 50% of the total retail price is received by Jens Ritter Instruments.
The order will be shipped once Jens Ritter Instruments has received full payment for the complete order. If for any reason a payment is not made within 6 months of sending the final invoice, the ordered goods automatically become property of Jens Ritter Instruments. Down payments are non-refundable for businesses. Down payments are non-refundable for consumers after the production of the ordere has started.
Jens Ritter Instruments will have the right to refuse or cancel any order whether or not the order has been confirmed. Any down payments made will be reimbursed by Jens Ritter Instruments.
§ 3 Delivery Times
The expected delivery date, mentioned on order forms or in any other forms of communication, can at any time be changed by Jens Ritter Instruments without prior notice.
§ 4 Shipping
For Dealers
Shipping costs are not included in the dealer prices. All shipping costs must be paid by the dealer.
For Consumers and businesses
Retail prices include shipping to the address provided by the consumer or business. If no shipping address is provided by the customer, Jens Ritter Instruments will use the invoice address.
Damage During Shipping
In case of damage during shipping, the recipient must contact and inform the transportation company and Jens Ritter Instruments within 24 hours (1 working day) with a detailed description, including pictures, of the damage to the product and/or packing. E.g. for an instrument: detailed documentation of the instrument, the case/gigbag and packaging.
Damage reports received later than 24 hours after receiving the instrument(s) are not covered by our insurance, and the recipient will have to bear the cost of repair.
Custom and VAT
Please note that all orders are shipped from Germany. Any import duties and taxes payable, will be charged once the parcel has reached the destination country. These charges must be paid by the recipient of the parcel. Jens Ritter Instruments is not in a position to inform the customer of these fees, and the customer is responsible for the payment of VAT and customs. If you have any questions related to customs charges, please contact your local customs office.
§ 5 Return Policy
Goods (except for custom made instruments) can be returned within 7 days of delivery. The amount paid will be refunded minus a 15% handling fee. It is not possible to return custom made instruments.
If you have paid for your order using a different currency than EUR, you will be refunded using the exchange rate of the date of purchase. Jens Ritter Instruments shall not be held responsible or accountable in case of unfavorable exchange rates evolution. Jens Ritter Instruments is not able to refund customs duties and taxes on orders shipped outside the EU. However, you may be able to recover these by contacting your local customs bureau directly.
§ 6 Warranty
Your new Jens Ritter instrument is warranted to be free from defects in materials and workmanship for five years from the delivery date. This warranty is made only to the original retail purchaser, subject to the limitations contained herein and is not transferable.
If at any time your instrument malfunctions as a result of faulty materials or workmanship, Jens Ritter Instruments will repair the defect(s) or replace the instrument, as it deems appropriate in its sole discretion. Jens Ritter Instruments reserves the right to use comparable materials readily available at the time of repair in the event that original materials are no longer available. If replacement of your instrument is deemed appropriate by our staff, Jens Ritter Instruments will replace the instrument with one of the same or most similar style of a value not in excess of the original purchase price of your instrument.
This warranty does not cover:
- Any instrument that has been altered or modified in any way beyond the original condition of the instrument as delivered to the customer.
- Any instrument that has been damaged due to abuse, misuse, negligence, accident, or improper operation.
- The subjective issue of tonal characteristics.
- Any instrument that has been subjected to extremes of humidity or temperature.
- Normal wear and tear (e.g., worn frets, worn machine heads, worn plating, string replacement, scratched pickguards, or damages to or discoloration of the instrument's finish for any reason).
- Any instrument upon which unauthorized repair or service has been performed by any third party other than Jens Ritter Instruments.
- Cracking, discoloration or damage of any sort to the finish or plating for any reason.
§ 7 Wood
Wood owes its inherent beauty to variations in color, grain, and texture, therefore, these variations are not considered defects. Due to the natural color and grain variances of wood substance, the final finish color, texture and grain may vary from one instrument to another even though they are finished at the same time. Exposure to light and the aging process will cause changes in surface color of natural wood products. Light finishes on wood products do not mask the natural characteristics of wood. Jens Ritter Instruments does not guarantee the exact matching of grain, pattern and color. Instruments will not be replaced because of these conditions:
- Natural variations in wood grain, veneer figure, character marks, texture or color
- Prominent evidence of natural characteristics of wood when light finishes are selected
- Variations in finish from one instrument to another
- Changes in finish surfaces due to exposure to light and/or the natural aging process
Color perceptions change from individual to individual, as almost everyone sees color differently.
We have done our best to display, as accurately as possible, the colors of the instruments shown on this website. However, due to above reasons, we cannot guarantee that the product you receive will be an exact match to what is being displayed on our product description page.
§ 8 Place of fulfilment and place of jurisdiction
The law of the Federal Republic of Germany shall apply with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
The place of fulfilment for all services and products arising from business transactions with Jens Ritter Instruments shall be Deidesheim, insofar as the customer is a merchant, a legal person governed by public law or a special fund under public law.
If the customer is a merchant, legal person governed by public law or special fund under public law, Bad Duerkheim shall be the exclusive place of jurisdiction for any disputes arising directly or indirectly from the contractual relationship with the customer or from these General Terms and Conditions of Business.
§ 9 Closing Provision
If any of these provisions cannot be applied for whatever reason, this shall not affect the validity of the remaining provisions.
